Rulings in Matters Under Advisement. Judge Jackson heard the assignment calendar, rendered decisions on matters under advisement, and set cases for trial before the jury yesterday. In Moore against Rundle the court found for the plaintiff, ordered judgment entered, and allowed $25 attorney fee to Mooney. In Stanley against the Rundle estate, the motion to strike from the answer was denied. In the suit of Knowles against the city, defendant's demurrer to the amended complaint was overruled. In the case of Suter against Bowker, the motion for a new trial was overruled. Separate demurrers of defendants in Lita Warren against the Luna Park Amusement company and others, and for damages for personal injuries, were taken under advisement. Demurrers were overruled in W. F. Gallatin against W. F. Anderson, William Jones against William Wright, and Rice Taylor against the city. Demurrer to counter-claim was sustained in Blanche Stuart against Caroline Gagnon and wife. Motion to tax costs was taken under advisement in W. F. Gallatin against the city. E. N. Harwood against McCarthy & McClennan, was transferred to Judge Carroll's court. **Divorces Granted.** Dorothy Butsick was granted a divorce from Walter Butsick on defendant's default. Jean Graig's marriage to Walter Graig was annulled by the court. The suit was grounded on the ground that said Graig makes himself while acting as a juvenile alien when he contracted his marriage with Jean, thrown his wife, who was a minor, and who had money without the consent of her parents, in contact with undesirable persons. Judgments were entered on plaintiff's worth in the suit of Fred Lund against J. R. Hayns and Thomas Lenn against Max Kurth. Lund was allowed $4,812.72. The suit of E. J. Strawsburger against the Butte & Superior Silver Mines company was continued to March 22. The state, on the relation of Nellie Beneatis, against the city, motion to quash city's mandates, was continued, subject to call. Bill of exceptions in the state against Gurian were signed. In this case the state is appealing from the action of the district court. The following jury cases were set: O. V. Thomas was set for March 16 and that of W. L. Daly against the company against Argenzinger brothers two trials set for Monday. Longmans department. The following cases were called: Butte Electric railway against Mike Gordon, March 14; Thomas L. McDonald against Montana Elevator company, March 14; Lorenzo against three defendant, March 11; Jack Ferris against Milwaukee railway, March 16; O. N. Higgenbotham and Higgenbotham against John Fill--15; William Ioch against L. H. Hale, March 13; W. M. Wilson against Butte Miner company, March 13; Steve Sanguinetti against J. Meagher, March 7; Rudge & Duggan, administrators, against John Loftus, March 22; Joseph Weinstein, March 19; John T. McCormac against New York Life, March 20; J. A. Bousaling against Gust Reiner, March 19; Mike Micholoke against Mike Nedio, March 6; Mike Wilson against Butte Automobile company, March 7; Independent Teal company against Beatrice Market, March 4; Bonette-Stern company against Joseph Messner, March 6. ### COURTHOUSE NOTES In the case of Mather Webb against J. Webb, action for divorce, attorneys have stipulated the defendant may have to March 7 to file an answer. Attorney Kirk has been on bond forfeited in the case of J. R. River against Mike Zins. John Halles has released his one-third interest in the estate of his deceased father. He was restrained from rendering the interest to his step-daughter Marie. The estate is valued at about $5,000. In a suit of Bom Jobined against the Milwaukee railway, the defendant demanded a deposit with the Milwaukee company. In the suit of Fred Lond against J. R. Mines, the defendant has drawn a Judgment for $1,618.12 has been filed in the district court. Defendant's motion to quash have been filed in the suits of Dora Cummins and Harvey Curtis against the city, action for damage taken up. Attorney Kain has been retained in the divorce suit of Mahala Hathaway against Harvey Hathaway, filed in district court. A petition on the application for probate of the will of Euphemia Vandross, who died January 24 of this year, was filed with the district court yesterday for March 14. The court notified the administrators that if they wished the matter heard before a jury they should present the notice of petition in advance of the date of hearing. In the Gagnon case, a final settlement of account and objections thereto were filed. $4,977.12 has been credited by the administrator to the Sullivan estate. There have been credited to the account of C. T. Sullivan, the court found. Originally, the share of the objector was $7,817.—something. The administrator is to be charged with $225.18 more. Against the net is to be assessed $135, director's proportion of $445 attorney fees. Anna A. Ouanes has filed a petition to have two little children declared wards of court; parents are James and Hazel Ouanes, now in trouble; the mother is married again in Texas. The children have no relatives in Butte. **TEMPLE MATERIAL ARRIVES.** With work on the resuming when weather is better, material ordered for a reinforced footing to the building, the court found yesterday, has arrived, according to Architect Wardaugh. It is now possible to further push the erection of the temple and permit— [illegible] Domestication of cattle began in prehistoric times. ## Column 3 # MURPHY-SOFTLEY CO. TO OBSERVE ANNIVERSARY Monday the Murphy-Softley company, women's furnishings house at 22 West Park street, will observe the third anniversary of its opening for business in Butte. The firm is composed of James J. Murphy and Kate W. Softley. Devoting themselves to the needs of the desire of Butte shoppers, Mr. Murphy and Mr. Softley have established themselves firmly in the mercantile life of the city. The Murphy-Softley company has made a host of friends not only in Butte, but in Anaconda and other Montana cities. The Murphy-Softley Co. is a store that has been there for the last three years. The firm has arranged an anniversary sale to begin Monday morning. With the approach of Easter it was considered that this would be a most opportune time to hold such an affair. Despite the fact that the firm was compelled to fight an adverse impression during the first few months after it became established, the wonderful support given it by the shopping public enabled it to come through in excellent fashion. The anniversary sale will last through the entire week, and spring and summer merchandise is being shown in profusion. --- ## LIEUTENANT HUNT ARRIVES IN BUTTE Lieut. Peter F. Hunt, U. S. N., arrived home from his station with the Pacific fleet at San Diego on Friday evening in time to attend the funeral of his father, J. N. Hunt. Some difficulty was encountered in locating the naval officer to notify him of his father's death, owing to the fact that his ship was on a short cruise. He will remain in Butte for about two weeks.
